Request for TSI Healthcare Letter

READ CAREFULLY: Regarding Flexibility Options
This letter is provided solely at the request of Client to document the organization’s decision to invoke the Meaningful Use 2014 Flexibility Final Rule (Flexibility Rule). Client hereby acknowledges that the organization is currently a client of TSI Healthcare and that it intends to attest to CMS that Client was unable to fully implement 2014 Edition certified EHR technology (CEHRT) due to delays in availability of the CEHRT. Client hereby acknowledges that TSI Healthcare is providing this letter for informational purposes only.  Any information provided by TSI Healthcare regarding the Flexibility Rule does NOT constitute legal advice, nor should it be relied upon by Client, or any related or unrelated third parties of Client, with regard to its decision to invoke the Flexibility Rule. Client also acknowledges and agrees that the decision to invoke the Flexibility Rule was made independently of any information provided by TSI Healthcare, including the informational letter being requested. Client understands that it is the responsibility Client’s organization and NOT TSI Healthcare to provide any and all documentation supporting this decision in the event of a CMS audit.

READ CAREFULLY: Regarding Meaningful Use Assistance
Failure to meet regulatory requirements or failure to implement and utilize the necessary technology will impact eligibility and may result in missed incentives and/or penalties. TSI Healthcare attempts to provide basic guidance of current policy, CMS guidelines, and NextGen documentation, and does not present these findings as expert advice regarding the federal policies, their requirements, data collection methods, or reporting guidelines.“Meaningful Use” requirements and other incentives programs are defined by the various agencies and offices of the US Federal Government. Incentive programs and requirements are part of HITECH Act and are administered by such agencies outlined therein and are subject to change. As guidelines change, NextGen’s approach and TSI Healthcare’s guidance may also be adjusted. TSI Healthcare does not administer incentive payments, guarantee eligibility, or guarantee the accuracy of analysis and any statements about the program. TSI Healthcare and the NextGen® family of products and services can only provide the tools to achieve these requirements; however the responsibility remains on the provider to achieve, correctly collect data, maintain documentation, and report on each measurement. Should the Client have any questions as to the interpretation of ARRA, the HITECH Act or other relevant rules, regulation or incentive programs, and/or their application to the specific practice, the Client should contact the appropriate government agency directly.
