CMS Eliminates Use of Consultation Codes
With an effective date of January 1, 2010, we understand that the CMS final rule CMS1413-FC, has officially eliminated the use of all consultation codes (99241-99255) for various places of services with the exception of telehealth consultation G-codes. With consultation codes no longer being recognized for Medicare Part B payment, CMS has increased work RVU's for several Evaluation & Management codes and is instructing physicians to code using the E/M codes that represent the location of the visit and the complexity of the visit performed.
Currently, this change only affects public health plan options as many commercial plans still continue to reimburse for consultation codes. We recommend that you verify with your payors whether they have made a change to their own policy in regards to this ruling. For example, the AAPC (American Academy of Professional Coders) reports that United Healthcare has already adopted the CMS regulations for its Secure Horizons, AARP Medicare Complete, Evercare, and AmeriChoice Medicare Advantage Benefit plans, but states that they will continue to recognize and reimburse the consultation codes for all commercial products at this time.
RAC is Racking Up on Fees
As many providers are now aware, Medicare's RAC (Recovery Audit Contractors) have moved in full force to audit medical charts in hospitals, practices, and suppliers. According to CMS, the Tax Relief and Health Care Act of 2006 authorized Congress's requirement for the RAC program to be permanently implemented nationwide by January 1, 2010. RAC is a program used to identify Medicare overpayments and underpayments to healthcare providers and suppliers. According to CMS, RAC audits in CA, FL, NY, MA, SC and AZ alone resulted in over $900 million being returned to the Medicare Trust Fund between 2005 and 2008.
What does this mean for your practice? According to CMS, RAC is set to review all providers claims for E&M services under Part B, whether a hospital, a physician practice, or a supplier. If your medical charts are audited, you risk large fines and potential termination of your Participating Provider Agreement, depending on the level of noncompliance. CMS/Medicare is not the only payor auditing providers' medical charges, but other payors have the right according to their Provider Agreements to assess medical charts.

e-Prescribing Incentive Change
Beginning January 1, 2010, if a medical provider prescribes at least one medication electronically, this will be reported with the new e-prescribe HCPCS code of G8553. The prior reporting codes of G8443, G8445 & G8446 will be deleted. This change will eliminate any confusion concerning what code to choose. If you e-prescribe one or more medications, G8553 will be reported. If no prescriptions are electronically prescribed, nothing is reported.
In addition, the qualifying for the incentive bonus payment is about to get easier. Currently, in order to qualify for the e-prescribe bonus, a provider must have a 50% rate of electronic prescribing for all prescriptions generated from his or her practice. For 2010, the physician will only need to electronically prescribe 25 times a year in order to qualify.
There are a few things to take into account as we approach these changes. The reporting code must always be reported with a unique face-to-face patient encounter in order to count towards the 25-visit minimum. Also, the definition of electronic prescribing does NOT include faxes.
